Association

What is a Homeowners Association (HOA)?

The Briardale Square Homeowners Association (HOA) is an entity legally created by a real estate developer for the purpose of developing, managing and selling our community of townhomes. It is given the authority to enforce covenants, conditions and restrictions and to manage the common grounds and amenities of our development.

Our homeowners association is a non-profit organization, run by volunteers and is subject to state statutes that govern non-profit corporations and homeowners’ associations.Briardale Square Townhouse complex is zoned as a “Planned Resident District” Sec. 29.1203 of the Code of Iowa).

A townhome differs from a condominium in two ways: a townhome is a block of attached buildings usually three to units eight long; the unit and the land upon which it sits is owned by the resident.When you buy or rent property in this complex you agree to a number of restrictive covenants adopted by the original owners and developers of Briardale Square.

The covenants are enforced by the Briardale Square Association Board of Directors. Please become familiar with the Bylaws, Articles and Covenants.

What is a Board of Directors?

Our Homeowners Association (HOA) is made up of volunteer directors, each charged with the conduct and management of our association’s affairs. The directors collectively are referred to as a Board of Directors. New members are appointed and approved by the Board. Our Board has four officers (President, Vice President, Secretary and Treasurer) and members at large. Board members may be residents or non-residents or owners or non-owners.

When does the Board of Directors meet?

The Board of Directors at Briardale Square meets at 7:00pm on the second Monday of every month in our Clubhouse. The Annual Meeting is held the second Monday of January. Everyone is welcome to attend and encouraged to get involved.

In an emergency call 911.

Maintenance assessment fees 

How much are the monthly HOA maintenance assessment fees?

The monthly HOA maintenance assessment fee for Briardale Square effective 7/1/20 is $150.00

What do the monthly HOA maintenance assessment fees pay for?

Common Area General Grounds Maintenance including: grass cutting, lawn fertilization, trimming bushes and trees, leaf removal, cutting down dead trees, mulching, gutter cleaning, sidewalk edging, planting flowers and replacement trees.Snow removal is also included in the winter months and includes a single walkway cleared to your door.Common Area Walkways and Parking Lots including: common area sidewalks, private street and parking asphalt repair, sealing, replacement and striping of parking stalls.

General Townhome Unit Exterior Replacement including: roof, siding, windows, doors, garage doors (not from damaged doors), bricks, fences, gutters, downspouts and exterior painting.Maintenance and Repair of

Amenities including: the clubhouse, swimming pool, basketball court, tennis court, benches, complex streetlights and signs, art sculptures and playground equipment.

Insurance Coverage, in general, covers: the Clubhouse and equipment in it, the common area property, liability on activities on the common ground and pool and director, officers and employee dishonesty.

When and how do I pay my HOA maintenance assessment fee?

The HOA maintenance assessment fees are due on the first day of each month and are late the first business day after the 10th; bills are NOT sent unless you are late. A finance charge of 10% is made each month on unpaid amounts. Contact the Board of Directors – Treasurer for an automatic withdrawal form, information and other questions.

What is the Association rule regarding unrelated persons living in one residence?

In no event shall more than two (2) unrelated persons occupy, use, purchase, own, rent or live in a single townhouse property, now or in the future.

Noise

What should I do if my neighbor is too loud?

We live in close proximity to each other and share common walls, so please be considerate of your neighbors with respect to your music and conversation levels, especially when holding parties/gatherings indoors or outdoors. At Briardale Square every resident is entitled to “quiet enjoyment” of their home. In an attempt to maintain harmony in the community, it is suggested that on the first occasion residents attempt to work out any noise issues between themselves.

If you are planning a party, it may be best to notify and inform your neighbors in advance. On the second or more occasions, you should discuss the concern with your neighbor, call the police and/or document the incident by reviewing and completing the “Incident Policy and Report”.

Fixing-up or remodeling your property

What can I do to fix-up, build-on or remodel my property?

You may fix-up or remodel the interior of your property at any time without approval. However, to maintain consistency within our complex, owners or residents may not build, modify, or add-on to the exterior of townhomes (i.e. deck, patio, egress windows) without the approval of the Board of Directors. You will need to send or bring a written plan and detailed drawing of your proposed project to a monthly board meeting for Board approval prior to beginning your exterior residence project.Be aware that the City of Ames requires a building permit whenever you are constructing, altering, converting, improving, repairing, demolishing, or moving a structure.

What is the pet policy at Briardale Square?

We live in a pet friendly complex; however, some animals are barred from Briardale Square outright. No livestock, poultry, snakes, apes, monkeys, pit bull dogs or animal larger than 30 pounds are allowed in any unit or on the complex. Household pets are allowed and include: no more than one (1) dog, or two (2) cats, or two (2) caged birds or two (2) caged animals per unit. If the number or size restriction are ignored, the Association will levy a $50 per month fine as long as the pets remain in the unit. This fine will be added to the monthly maintenance assessment. Pets allowed outdoors (i.e. dogs or cats) must always be on a leash. You must pick up after your pet immediately. Briardale Square adheres to the City of Ames ordinances regarding pets which include the City’s ordinance pertaining to barking dogs.

What are the complex parking rules?

Briardale Square Homeowners Association Declarations states that each home has two (2) designated spots to park in addition to their respective garage. Boats, trailers, campers and junk vehicles may not be parked more than 48 hours on any lot, parking area or common area on the property.The Board recognizes that residents might need to park an additional car or a visiting vehicle outside their designated spots for longer than 48 hours. The large west parking lot off Truman Place facing Hoover has been designated as temporary long-term parking. If you use the long-term parking lot, you are responsible for maintaining your vehicle. Vehicles with flat tires or that won’t start; junk vehicles or vehicles that are not moved at least once a month in the long-term parking lot will be towed without prior notification.

How do I report a non-compliance issue or a violation of our HOA policies?

If you are aware or involved in a violation of HOA policies, you may report the issue by documenting it on an “Incident Report” and providing a copy to the Property Manager. If a law or city ordinance has been broken, the local police should be called to report the incident.

Clubhouse

How do I rent the clubhouse and what is the cost?

Residents have access to the clubhouse. To reserve the clubhouse, email the board at briardalehoa@gmail.com with your name, phone number, address and date(s) you’d like to reserve it for. There is no rental fee for all residents of Briardale Square; however a $100 damage deposit is required when you pick up the key. If the clubhouse is left in satisfactory condition, the deposit will be returned. If there is any damage or cleaning not done, other than normal wear and tear, your damage deposit will be used for repair and/or clean-up.

Work order requests

How do I request a repair on something my HOA maintenance assessment fee pays for?

You own your home and are responsible for all repairs and maintenance in the interior of your home. To request a repair for common area, unit exterior, grounds, parking lot or amenities email the property manager at briardalehoa@gmail.com .In the event that the need for maintenance, repair or replacement is due to a willful or negligent act of the owner, tenant, family, or guests or by fire and other acts of nature, the cost of such to maintain, repair or replace the damage shall be the responsibility of the homeowner.

tv/cable/dish

Can I install a satellite TV antenna, dish or cable?

Yes, you may elect any cable or satellite vendor and install equipment specific to the vendor of your choosing.

NOTICE: be cautious of how you mount or attach your equipment, because if attaching your equipment penetrates either the siding or roofing on your complex and there is water damage or rain seeping into your unit any time in the future, you will be responsible for all damages and costs of repair.

Boundaries

What are my property boundaries and rules associated with them?

Your property extends front and rear (and possible side) of your unit. Each unit is different and the Briardale Square Property Manager should be contacted so you know your unit’s specific property lines. It is your responsibility to care, maintain or replace trees, shrubs, flowers, mulch, decks or patios on your property.

Insurance

What type of insurance do I need?

Property owners are required to have and annually provide the Property Manager their insurance policy “Declaration Page” showing full Property Coverage at 100% of your properties current value, General Liability (GL) and Personal Property insurance to cover your personal effects. Many residents also add an Umbrella Policy to their coverage. All townhome insurance policies must list the Briardale Homeowners Association as “An Additional Insured” on the policy.

What does the Briardale Square insurance policy cover?

The Briardale Square insurance policy covers the Clubhouse and equipment in it, the common area property, liability on activities on the common ground and pool and director, officer and employee dishonesty. The HOA policy DOES NOT cover the exterior elements of the unit.

 

Disposal

Who do I use for garbage removal?

Garbage removal is not covered in the HOA fees. You will need to set up and establish a sanitary waste removal company for your waste removal. There are multiple vendors that service our complex. Please remember to put your trash bin out on collection day (or the night before) and return your bin after pick up. Bins should be left out of sight from the street except for on collection day. Dumpsters are sometimes placed in front of a unit for the owner’s use or in a parking area for a contractor’s use. They are not to be used for other trash.

How do I dispose of furniture or large construction debris?

Please DO NOT leave furniture, appliances, electronics, mattresses or other large household or construction debris on the curb or anywhere on the common areas. Call your garbage vendor and request a pick up of your item. Some garbage vendors will do this for free, while others may have a charge for the item they remove.

How do I dispose of leaves, weeds and pruned trees and shrubs?

Because we all want to keep Briardale Square attractive, please keep your property free of clutter visible from the street. Keep the trees, scrubs and flowerbeds on your property pruned and your area weeded and free of leaves. The Association may require weeding or trimming at the owner’s expense if your lot gets overgrown. Please work with your current waste disposal company on the removal of this waste.
